1. Definitions and Interpretation
1.1 In these conditions:- "Code" means any computer language or
code used by WSS in the creation of the Website "Intellectual Property"
means all or any of trade marks trade names patents know-how copyright designs
and software "Service Provider" means a company contracted to host
the Website on its servers in order to allow the viewing of the Website by
Users "Services" means the provision by WSS of the Website "Students"
means all foreign under graduate, post graduate, language or further education
students studying in the Area "User" means anyone visiting the Website
"Website" means WSS's Website providing information to Students
about the area.
"WSS" means World Study Solutions Limited of 19 City Road Cambridge,
CB1 1DP.
1.2 Words denoting the masculine gender shall include the feminine and neuter
genders and vice versa and words denoting the singular shall include the plural
and vice versa
1.3 The headings in this conditions are for convenience only and shall not
affect their interpretation.
1.4 Any reference in these conditions to any provision of a statute shall
be construed as a reference to that provision as amended, re-enacted or extended
at the relevant time.
2. Use of Website
2.1 Access to and use of Website is subject to these terms and conditions.
2.2 WSS reserves the right to change the terms and conditions relating to
the Website. The User is responsible for regularly reviewing these terms and
conditions and additional terms as posted on the Website. The User's continued
use of the Website constitutes his agreement with WSS to all such amended
or additional terms and conditions.
2.3 WSS may at any time without notifying the Users make any changes to the
Services which are necessary to comply with any safety or other statutory
requirements or which do not materially affect the nature or quality of the
Services.
3. Disclaimers
3.1 WSS will not be responsible for the outcome of any decision made as a
result of any information displayed on the Website.
3.2 WSS shall not be deemed to endorse any of the venues or services referred
to on the Website.
3.3 WSS does not warrant that the Website will remain fully operational at
all times and will not be affected by malicious attacks, viruses and denial
of service attacks
3.4 WSS gives no warranty for the quality reliability or service of any third
party Service Provider and does not warrant that the operation of the Website
will be uninterrupted or without error.
3.5.1 In respect of any good or services offered on the Message Board, WSS
shall have no liability or responsibility with regard thereto nor with regard
to any fitness for purpose or suitability or defect in such goods or services.
3.5.2 Except in the respect of death or personal injury caused by WSS's negligence
WSS shall not be liable by reason of any representation (unless fraudulent)
or any implied warranty, condition or other term or any duty at common law
or under the express terms of these conditions for any direct or indirect
or consequential loss damage costs or expense of any kind whatever and however
caused (including any loss of profit, loss of business or any other indirect
special or consequential loss) which arises in connection with such goods
or services, as referred to in clause 3.5.1 3.6 WSS will use its best endeavours
to ensure that the information displayed on the Website is kept up to date
but WSS shall not be responsible for any inaccurate or out of date information.
4. No Unlawful or Prohibited Use
4.1 The User shall not post anything on the Website or on the Message Board
thereof which would result in the display or dissemination of the following:-
4.1.1 Anything which may defame abuse harass threaten or otherwise violate
the legal rights of others
4.1.2 Any inappropriate profane defamatory obscene indecent or unlawful material
or information
4.1.3 Any material or information that incites or is likely to incite discrimination,
hate or violence towards one person or a group because of their sex or sexual
orientation or because of their belonging to a race, a religion or a nation
or that insults the victims of crimes against humanity by contesting the existence
of those crimes
4.1.4 Material that contains viruses, Trojan horses, worms, time bombs, cancelbots,
corrupted or any other similar software or programs that may damage the operation
of another's computer or property of another
4.1.5 Information or material that violates any applicable laws or regulations
5. Intellectual Property Rights
5.1 The property and copyright or other intellectual property rights in the
design layout and where applicable the contents of the Website shall belong
to WSS
5.2 Copyright in any Code used in the provision of the Services or the Website
shall remain the property of WSS but WSS shall grant to the User a non-assignable
non- exclusive licence to use the Code for the purpose of using the Services
and the Website but for no other purpose provided the User keeps intact all
copyright and other proprietary notices. Any reproduction or redistribution
of the content and/or Code is expressly prohibited by law and copying or reproduction
of the content and/or location for further reproduction or re-distribution
is expressly prohibited.
6. Data Protection
6.1 WSS warrants that it is registered under the Data Protection Act 1998
and shall comply with the provisions of the Act.
6.2 The Data Protection Compliance Policy of WSS is set out in the following
schedule SCHEDULE Introduction The Internet is not a secure medium but WSS
has taken every possible step to ensure the security of the User's data. WSS
will not disclose any of the User's personal details to any advertiser on
the Website or to any third party. Data Controller WSS is the Data Controller
for the purposes of the Data Protection Act 1998. Purposes of Data Data submitted
to the WSS Website will be used for the stated purpose listed and agreed to
at the point of submission of data. Additional services made available to
Users will not make use of the submitted data beyond that for which the User
who is the data subject has given approval.
The data submitted to the WSS database may be entered or processed by WSS
where necessary. Personal data will be kept confidential by WSS at all times.
Data Transmission The highest levels of available security have been implemented
to safeguard the security of data both during transmission, storage and retrieval
and to prevent unauthorised access. Data Storage Data will be stored on the
Server as long as is necessary for the above stated purposes. Obsolete data
may be archived on to the Server. Consent By submitting information the User
consents to the use of that information as set out in this policy. If WSS
changes it Compliance policy, it will post the changes on the Website so that
the User may be aware of the information WSS collects and how WSS uses it
at all times.
Continued use of the Website will signify that the User agrees to any such
changes.
